Strengthening personal data protection through the creation of a regulatory body

Introduction: The protection of personal data has become a central issue in the digital era, especially in Ecuador, where the Organic Law on the Protection of Personal Data seeks to guarantee the privacy of information. However, the law's implementation process has been the subject of debate due to its perceived inadequacy in ensuring effective protection. Therefore, this research seeks to strengthen the protection of personal data in Ecuador through the creation of a regulatory entity dedicated to applying sanctions in the legal field in Ecuador.
Methods: A quantitative approach was used, as well as a digital survey applied to lawyers in the Republic of Ecuador to evaluate their knowledge, perception and experience regarding the regulations. As well as identifying areas for improvement in legislation and its application.
Results: The results revealed that, although a large majority of respondents are aware of the LOPDP, only 30% have considered that the law adequately protects their data. Furthermore, 90% supported the creation of a regulatory entity, and 85% considered it necessary to have judges specialized in computer law.
Conclusions: It has been concluded that the Organic Law on the Protection of Personal Data presents deficiencies in its application, highlighting the priority of creating a regulatory entity and training judges specialized in the subject. Likewise, the need to improve education and awareness in the protection of personal data was identified to achieve effective implementation.
